These Terms of Service (“Terms”) govern your access to and use of the website at oathcertified.org and the OathCertified certification platform (collectively, the “Service”), operated by OathCertified (“we,” “us,” or “our”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. About OathCertified
OathCertified is a voluntary certification platform created by insurance professionals for insurance professionals. Our mission is to restore trust in the insurance industry by providing a free, publicly verifiable certification that demonstrates an agent’s commitment to transparency, ethical conduct, and client-first advocacy.
When you become OathCertified, you sign an open letter — the Oath — publicly affirming your commitment to act in your clients’ best interests, never misrepresent a policy, refuse to engage in or tolerate fraud, provide honest guidance across all lines of coverage, and uphold the dignity of the profession. Your identity is verified, and you receive a unique certification number tied to your name, your license, and your word.
The Service is and always will be 100% free. There are no fees, no subscriptions, no annual renewals, and no financial commitments of any kind.
2. Eligibility & Registration
To use the Service and obtain certification, you must:
- Be at least 18 years of age.
- Hold a valid, active insurance license in at least one U.S. state or territory.
- Provide accurate, complete, and truthful information during registration and identity verification.
- Agree to and sign the OathCertified Oath in good faith.
You represent and warrant that all information you provide is accurate and current. You are solely responsible for maintaining the accuracy of your information and for all activity that occurs under your certification.
3. The Certification
OathCertified certification is a voluntary, non-regulatory designation. It is not a government license, a compliance requirement, or a substitute for any state or federal regulatory obligation. It is a public declaration of your personal and professional commitment to the principles outlined in the Oath.
We reserve the right to revoke, suspend, or modify any certification at our sole discretion, including but not limited to cases of fraud, misrepresentation, violation of these Terms, or conduct that we determine undermines the integrity of the platform.
4. Your Data & Our Rights
By using the Service, you grant OathCertified a perpetual, irrevocable, worldwide, royalty-free, fully transferable, and sublicensable right and license to use, reproduce, modify, distribute, display, publish, and create derivative works from all data, content, and materials you provide or that are generated through your use of the Service.
This includes, without limitation:
- Your name, likeness, professional credentials, license information, and certification status.
- Your signed oath, verification results, certification badge, and any associated public posts or publications.
- Any biometric or identity verification data collected during the certification process.
- Usage data and interaction patterns on the platform.
All certification records, verification data, signed oaths, badges, and derivative materials are and shall remain the sole property of OathCertified.
5. Sharing with Third Parties
You acknowledge and agree that OathCertified may share your information — including personal, professional, and certification data — with third parties at our discretion. Third parties may include, but are not limited to:
- Insurance Carriers: We may share your certification data, professional credentials, and verification status with insurance carriers for the purpose of credentialing, partnerships, agent matching, or any other purpose.
- Industry Partners: Managing general agents (MGAs), field marketing organizations (FMOs), aggregators, and other industry participants may receive your information.
- Advertisers & Sponsors: We may provide information about you as a certified agent to advertisers, sponsors, or marketing partners for targeted advertising, lead generation, or promotional purposes.
- Data Purchasers: We may sell, license, or otherwise provide your data — individually or in aggregate — to third parties for commercial, research, or analytical purposes.
- Public Access: Certain certification information (your name, certification number, and status) is publicly accessible by design and may be indexed by search engines.
6. Right to Monetize
The Service is provided free of charge. In consideration of this free access, you acknowledge and agree that OathCertified reserves the unrestricted right to monetize, commercialize, or otherwise derive revenue from any and all data collected through the Service, now or in the future. This includes any monetization model we may adopt, including but not limited to:
- Selling or licensing data to carriers, agencies, or other industry participants.
- Providing lead generation, agent matching, or recruitment services.
- Displaying advertisements or sponsored content.
- Offering premium services, analytics, or insights derived from platform data to third parties.
- Any other lawful commercial use of the data at our sole discretion.
7. Intellectual Property
The OathCertified name, logo, certification badge, oath text, website design, and all associated branding, content, and materials are the exclusive intellectual property of OathCertified and are protected by applicable intellectual property laws.
You may display the OathCertified badge and reference your certification status in professional materials, provided you do so accurately and in accordance with any brand guidelines we publish. You may not alter the badge, misrepresent your certification status, or use our intellectual property in any manner that implies endorsement of products, services, or conduct not sanctioned by OathCertified.
8. Prohibited Conduct
You agree not to:
- Provide false, misleading, or fraudulent information during registration or at any time.
- Impersonate another person or misrepresent your identity or licensure status.
- Use the Service for any unlawful purpose or in violation of any applicable law or regulation.
- Attempt to interfere with, compromise, or disrupt the Service or its underlying infrastructure.
- Scrape, harvest, or extract data from the Service through automated means without our prior written consent.
- Use the OathCertified certification or badge in a deceptive or misleading manner.
9. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. We disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy.
OathCertified does not guarantee that the Service will be uninterrupted, error-free, or secure. We do not endorse, verify, or guarantee the conduct, competence, or performance of any certified agent. Certification reflects only that an individual has signed the Oath and completed identity verification — it is not a guarantee of ethical behavior, professional competence, or regulatory compliance.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OATHCERTIFIED AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY.
OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100.00).
11. Indemnification
You agree to indemnify, defend, and hold harmless OathCertified and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any third-party rights.
12. Modifications to These Terms
We reserve the right to modify these Terms at any time by posting updated Terms on the Service. The “Last Updated” date at the top of this page indicates when the Terms were most recently revised. Your continued use of the Service after any modifications constitutes your acceptance of the updated Terms.
13. Termination
We may suspend or terminate your access to the Service and/or revoke your certification at any time, for any reason, with or without notice. Upon termination, these Terms shall continue to apply to any data previously collected and any rights previously granted to OathCertified.
14. Governing Law & Disputes
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of laws principles. Any disputes arising out of or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in the State of Florida, and you consent to the personal jurisdiction of such courts.
15. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable.
16. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and OathCertified regarding your use of the Service and supersede all prior agreements, understandings, and representations.
